1. Booking and Payment
- All clinic bookings must be confirmed with full payment in advance.
- Payment is strictly non-refundable and non-transferable under any circumstances.
- Clinic spots are strictly limited and allocated on a first-come, first-served basis upon receipt of payment.
- Accepted payment methods will be specified in the clinic booking process.
- Marcel Loeb Equestrian reserves the right to cancel or reschedule clinics due to weather, safety concerns, or insufficient bookings. See section 2 for details.
2. Cancellation Policy
- Participant Cancellations: Once a booking is made and payment is received, no refunds or credits will be issued for participant cancellations under any circumstances (including but not limited to illness, injury, horse unsoundness, travel issues, or personal emergencies).
- Clinic Cancellations by Marcel Loeb Equestrian: If a clinic is cancelled by Marcel Loeb Equestrian (e.g., due to insufficient bookings, instructor illness, or other circumstances beyond control), participants will be offered a full refund or the option to transfer to a future clinic.
- Inclement Weather: Clinics are generally held rain or shine. If the venue is undercover or has an indoor arena, the clinic will proceed as planned unless weather conditions are deemed unsafe by Marcel Loeb Equestrian or the venue.
- If weather conditions are deemed unsafe (e.g., extreme storms, unsafe heat, or other hazardous conditions), Marcel Loeb Equestrian will communicate any changes or cancellations to participants via email.
- Participants are responsible for checking their email the day before and prior to departure for any updates.
- Where possible, alternative indoor venues or rescheduling will be offered. If the clinic cannot proceed safely and must be cancelled by Marcel Loeb Equestrian, a full refund or transfer will be provided.
- Force Majeure: Marcel Loeb Equestrian will not be liable for any failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, or pandemics.
3. Participant Requirements
- All riders must bring their own horse. Horses are not provided.
- All riders must wear an Australian Standard Approved riding helmet and appropriate riding attire at all times while mounted.
- Participants must be competent to ride independently at walk, trot, and canter unless otherwise specified for a particular clinic.
- Horses must be sound, well-behaved, and suitable for a group riding environment. Unruly or unsafe horses may be asked to leave the arena at the discretion of the Coach or Venue Staff, with no refund provided.
- Horses must be in good health and up to date with vaccinations and worming as required by law or the venue.
- All participants must complete and submit the required waiver form(s) prior to participating.
- In addition, participants are required to complete any waiver(s) required by the venue prior to participating in the clinic.
- Minimum participant age is 16 years unless otherwise specified in the clinic description.
- For participants under 18 years of age, a parent or legal guardian must sign all waivers and forms, and must be present at the clinic at all times.
4. Transport
- All transport arrangements for horses and participants are the sole responsibility of the participant.
- Participants must ensure their horse is able and willing to load and travel safely to and from the clinic venue.
- Marcel Loeb Equestrian does not provide horse transport services for clinics unless specifically stated in the clinic description.
- Participants are responsible for ensuring their vehicle and any horse trailer used are roadworthy, legally compliant, and suitable for the journey.
- Marcel Loeb Equestrian is not responsible for any transport-related issues, delays, accidents, or incidents occurring while traveling to or from the clinic.
5. Safety, Liability, and Inherent Risks
- Horse riding is an inherently dangerous activity. By booking and participating in any clinic, participants acknowledge and accept these risks and agree to sign a waiver prior to participation.
- Marcel Loeb Equestrian maintains public liability insurance; however, participants are strongly encouraged to have their own personal accident and equine insurance.
- Participants must follow all safety instructions and directions given by the instructor and venue staff at all times.
- Marcel Loeb Equestrian reserves the right to exclude any participant or horse deemed unsafe or not adhering to clinic etiquette, with no refund.
- Nothing in these terms and conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded, restricted, or modified by agreement.
6. Health and Medical
- Participants must disclose any medical conditions, allergies, or injuries that may affect their ability to ride safely.
- Emergency contact details must be provided and kept up-to-date.
- First aid will be available on-site, but participants are responsible for their own ongoing medical needs.
7. Arrival and Conduct
Participants must be on time as specified in the clinic description. Late arrivals may result in reduced session time or exclusion from the clinic with no refund or credit.
Respectful behaviour toward other participants, horses, and venue facilities is required at all times.
All participants must adhere to the following Arena & Clinic Etiquette guidelines:
- Maintain Safe Distances: Leave a safe distance of at least 2 meters between yourself and other riders and horses.
- Supervise Your Horse: Do not leave your horse unattended at any time.
- Clean Up After Yourself: Please clean up after yourself and your horse, including any horse manure.
- Respect Privacy: No video or photography during the clinic to respect the privacy of all participants.
- Arrive Prepared: Arrive early enough to be tacked up and ready by your scheduled start time.
- Dress Appropriately: Helmet, boots, and tidy riding attire are compulsory.
- Follow Instructions: Listen to and follow all instructions from the Coach and Venue Staff at all times.
- Treat the Property: Treat the property, facilities, and equipment with care – use only designated areas for parking, tacking up, and riding.
- No Smoking: Smoking is not permitted at the venue, including in or around the stables, arena, or parking areas.
- No Dogs: Dogs are not permitted.
- Spectator Guidelines: Spectators must remain in designated areas and not enter the arena or horse zones.
- Limit Phone Use: Keep mobile phones silent and use only when necessary – not during mounted activities.
- Be Courteous: Be courteous, respectful, and supportive of fellow riders – help create a friendly, inclusive environment.
- Report Issues Promptly: Immediately report any hazards, injuries, or concerns to the Coach or Venue Staff.
- Adherence to Etiquette & Safety: If any clinic etiquette rules are not followed, or if your horse is misbehaving and poses a risk to others, you may be asked to leave the arena at the discretion of the Coach and Venue Staff. No refund or credit will be given.
Marcel Loeb Equestrian reserves the right to refuse service to any participant at their discretion.
8. Photography, Media, and Privacy
- Marcel Loeb Equestrian may take photographs or videos during clinics for promotional purposes.
- By participating, riders consent to the use of their image in marketing materials unless they specifically opt out in writing via email to marcel@mlequestrian.com.au.
- No video or photography by participants during the clinic.
- Personal information collected for clinic participation will be handled in accordance with the Marcel Loeb Equestrian Privacy Policy.
- By booking a clinic, you agree that you may be contacted with promotional materials via your provided contact details. You may opt out of promotional communications at any time.
9. Venue and Facilities
- Participants use all venue facilities at their own risk.
- Marcel Loeb Equestrian is not responsible for damage to, or theft of, personal property.
- Participants must follow all venue-specific rules and regulations, including parking and tacking up instructions.
10. Disputes and Complaints
- Any concerns or complaints should be raised directly with Marcel Loeb Equestrian as soon as possible.
- Marcel Loeb Equestrian will make reasonable efforts to resolve any issues fairly and promptly.
- If a complaint cannot be resolved informally, participants may request a review in writing within 14 days of the clinic.
11. General
- These terms and conditions apply to all clinics run by Marcel Loeb Equestrian, now and in the future, unless otherwise stated in writing.
- These terms and conditions are governed by Australian law.
- Marcel Loeb Equestrian reserves the right to update or amend these terms at any time with reasonable notice.
- By booking a clinic, participants acknowledge they have read, understood, and agree to these terms and conditions.
